Privacy Policy

Draft — written for internal review, not yet reviewed by an attorney
This is a draft prepared for founder review, not a finished legal document. It's written to accurately describe how the platform currently handles data, but hasn't been reviewed by an attorney, and state privacy laws (California, Virginia, Colorado, and others) each have specific requirements this draft only summarizes generally. Bracketed items like [Company Legal Name] need to be filled in. Review before real users rely on it.

1.Scope

This Privacy Policy describes how OFF MARKIE ("we," "us," "our"), operated by [Company Legal Name], collects, uses, and shares information in connection with the OFF MARKIE website and related services (the "Service"). It applies to all visitors, registered users, sellers, and buyers.

2.Information We Collect

Account information

When you create an account: your email address and password (stored in encrypted/hashed form, never in plain text).

Seller profile information

Zip code, property or business category, listing details, photos, videos, attachments, and links you choose to upload. Separately: your full name, street address, and email — collected to tie a profile to a verifiable real person, but never displayed publicly.

Buyer profile information

Zip codes of interest, category, buyer status (just looking / pre-approved / relocating), and any budget or preference details you provide.

Comments

The text of any comment you post, associated with your account.

Automatically collected information

Standard technical data such as IP address, browser type, device information, and usage patterns (pages visited, actions taken), collected via server logs and, if enabled, analytics tools. See Section 6 for details on cookies.

3.What's Public vs. Private

Public Visible to anyone who visits the Service, logged in or not: zip code, category, listing/profile details, photos, videos, links, and any comments you post.

Private Never shown publicly unless you choose otherwise: your full name and personal email are always private. Your street address is private by default — sellers may optionally choose, at the time they create or edit their profile, to display their exact address publicly instead of just their zip code. This choice is off by default, requires an explicit opt-in action, and can be reversed at any time by editing the profile.

4.How We Use Information

5.How We Share Information

We do not sell your private personal information (name, address, email) to data brokers or advertisers. We may share information in the following limited circumstances:

6.Cookies & Similar Technologies

We use essential cookies or local storage required for login sessions and basic site functionality. If we add analytics or advertising technologies in the future, this Policy will be updated to describe them and, where required by law, we will obtain your consent before using non-essential tracking technologies.

7.Data Retention

We retain your account and profile information for as long as your account is active. If you delete your profile or account, we will remove your profile from display and delete your private information (name, address, email) within a reasonable period, except where we are required to retain certain information for legal, security, or fraud-prevention purposes.

8.Data Security

We use industry-standard measures to protect your information, including encrypted password storage, database-level access controls separating public from private data, and restricted administrator access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9.Your Choices & Rights

10.State Privacy Rights

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive privacy law, you may have additional rights, which may include the right to: know what personal information we hold about you; request deletion or correction of your personal information; opt out of the sale or sharing of personal information (we do not sell personal information as described in Section 5); and not be discriminated against for exercising these rights. To exercise these rights, contact us using the information in Section 13. We will verify your request before acting on it. [This section is a general summary and should be reviewed by counsel for compliance with the specific requirements of each applicable state law.]

11.Children's Privacy

The Service is not directed to, and we do not knowingly collect personal information from, anyone under the age of 18. If we learn we have collected information from someone under 18, we will delete it.

12.Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be indicated by an updated effective date or, where appropriate, direct notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
